Conor Fitzpatrick pleaded guilty to conspiracy to traffic in stolen personally identifying information, fraudulent solicitation of personally identifying information, and possession of child pornography. While released on bond awaiting sentencing, Fitzpatrick violated his conditions of release by secretly downloading a virtual private network and accessing the Internet without his probation officer's knowledge. At sentencing, the district court calculated Fitzpatrick’s advisory Guidelines sentencing range to be 188 to 235 months’ imprisonment but sentenced him to a 17-day time-served term of imprisonment, citing his autism spectrum disorder and youth.

After an appeal by the United States the original owner of BreachForums Conor Brian Fitzpatrick has had his sentence of 20 years of supervised release vacated and will be resentenced:

“As the case returns to the district court, Fitzpatrick faces the possibility of a significantly longer prison term. The appellate ruling suggests that mitigating factors such as autism and youth cannot overshadow the severity of his crimes or the risks posed to public safety.”

So he may be locked up for longer

He was detained/jailed for 17 days in a less harsh unit for violating the terms of his bond while he was out awaiting sentencing. That's the only time he was ever really detained from his arrest until now and it wasn't a prison. 

When he is re-sentenced in February, it will be the first time he is actually sentenced to prison (if he is sentenced to prison, and odds are, he likely will be sentenced to prison). His defense counsel seems to be hot on arguing that U.S. prisons cannot adequately house and treat people with autism. He's got all kinds of research on that that he wants to argue. If it's the same judge who sentenced Pom originally, she might be a bit sympathetic to those arguments, but it's clear that the appellate court expects the lower court to come up with a sentence that will suitably punish Pom, protect the public, and serve as a deterrent to others.
